STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to doula and lactation service provider certification.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1 New Subdivision; Medicaid Reimbursement-Eligible Doulas and Lactation Service Providers. Amend RSA 310-A by inserting after section 221 the following new subdivision:

Medicaid Reimbursement-Eligible Doulas and Lactation Service Providers

310-A:222 Doula and Lactation Service Provider Certification.

I.  For the purposes of Medicaid reimbursement, the office of professional licensure and certification shall establish, pursuant to RSA 310:6, a voluntary doula certification process and a voluntary lactation service certification process to certify lactation service providers. The doula and lactation consultants certified by the office of professional licensure shall be credentialed by an organization accredited by the American National Standards Institute, the National Commission for Certifying Agencies, or another nationally or internationally recognized accreditation organization identified by the office of professional licensure. Coverage levels of such services are separately subject to Medicaid rules and regulations and shall not supplant federal funds.

II. The office of professional licensure and certification shall adopt rules pursuant to RSA 541-A relative to the authority set out in paragraph I.  

III.  The office shall make every effort to include racially and geographically diverse community members and providers when developing and implementing the doula and lactation service provider certification process pursuant to this section.

IV. Nothing in this section shall prevent a person certified by this state pursuant to any other provision of law from performing the occupation for which he or she is certified.

2 Effective Date. This act shall take effect on July 1, 2024.

METHODOLOGY:

This bill directs the Office of Professional Licensure and Certification (OPLC) to establish a voluntary certification process for doula and lactation service providers.  The OPLC states this bill creates a new obligation for the OPLC to create a process to certify individuals in two new occupational certifications including doulas and lactation service providers.  To administer this bill the OPLC would need to hire a Program Assistant II, labor grade 15, step one starting at $69,000 in FY 2025, $71,000 in FY 2026 and $73,000 in FY 2027.  The OPLC may also need additional support for the promulgation of rules and legal support.

 

Additionally, the OPLC projects a certification fee of $300 for two years for both doulas and lactation service providers.  Estimated Revenue by Year:

 

Doula Licensing:

  • FY 2025: $9,000 (30 licenses at $300 each for the biennium)
  • FY 2026: $600 (2 new licenses at $300 each)
  • FY 2027: $10,200 (34 licenses - new and renewal - at $300 each for the biennium)

Lactation Service Provider Licensing:

  • FY 2025: $15,000 (50 licenses at $300 each for the biennium)
  • FY 2026: $1,500 (5 new licenses at $300 each)
  • FY 2027: $18,000 (60 licenses - new and renewal - at $300 each for the biennium)

 

This breakdown outlines the anticipated revenue from certification fees for doulas and lactation service providers across the fiscal years, considering initial licensing, renewals, and new licenses issued.

 

This bill does not establish or provide an appropriation for new positions.
