STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT increasing the personal needs allowance of nursing home residents and certain other residents and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

213:1 Personal Needs Allowance Increased. Amend RSA 167:27-a to read as follows:

167:27-a Personal Needs Allowance of Residents of Nursing Homes.

I. The commissioner of health and human services shall permit each medical assistance recipient approved for nursing home payments to retain from the recipient's monthly income a certain amount a month for personal needs. Such amount shall be established by the commissioner pursuant to RSA 541-A and in accordance with federal regulations, but in no event shall the amount be less than [$50] $56. If the net monthly income of such a recipient is less than the amount established by the commissioner, the commissioner shall provide sufficient old age assistance, aid to the permanently and totally disabled, or aid to the needy blind to allow the recipient an amount equal to the monthly amount established as allowance for the recipient's personal needs.

II. Every 5 years, the commissioner shall make the adjustment for cost of living increases in the personal needs allowance to reflect social security increases.

213:2 Appropriation. The sum of $120,000 is hereby appropriated for the fiscal year ending June 30, 2006 to the department of health and human services, for the purposes of section 1 of this act. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

213:3 Effective Date. This act shall take effect July 1, 2005.
