AN ACT requiring notice of the installation of smoke detectors prior to the sale of residential property.

ANALYSIS

This bill requires a seller to notify the buyer of certain residential property that the property has an approved automatic fire warning device.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT requiring notice of the installation of smoke detectors prior to the sale of residential property.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Conveyances of Realty; Notification of Installation of Smoke Detector Prior to Sale of Residential Property. Amend RSA 477 by inserting after section 4-f the following new section:

477:4-g Notification of Installation of Smoke Detector Prior to Sale of Residential Property. Prior to the sale or transfer of any residential property which, pursuant to RSA 153:10-a is required to be equipped with an automatic fire warning device, the seller shall certify in writing to the buyer that the building is equipped with an approved automatic fire warning device that is less than 10 years old and powered by the house electrical service, on every level, hallways adjacent to each sleeping area, and each sleeping area. Nothing in this section shall preclude the owner from using a complete automatic fire alarm system to meet this requirement.

2 State Board of Fire Control; Fire Protection and Warning Devices. Amend the section heading of RSA 153:10-a to read as follows:

153:10-a Fire Protection and Warning Devices in [Multi-Family] Dwellings.

3 Effective Date. This act shall take effect January 1, 2006.
