AN ACT prohibiting the use of drugs and poisons in hunting.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT prohibiting the use of drugs and poisons in hunting.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Fish and Game General Provisions; Drugs and Poisons Prohibited. Amend RSA 207 by inserting after section 4 the following new section:
207:4-a Prohibited Methods of Taking. No person shall take any wild animal or wild bird in this state by the use or assistance of a drug, poison, tranquilizer, or muscle relaxant. Possession of any such substance by any person while hunting shall be prima facie evidence that the substance is possessed for use in the violation of the provisions of this section. This section shall not apply to the executive director or authorized agents engaged in removing nuisance animals or birds.
2 Effective Date. This act shall take effect January 1, 2006.
