AN ACT transferring the New Hampshire estuaries project from the department of environmental services to the university of New Hampshire.

This bill transfers the New Hampshire estuaries project from the department of environmental services to the university of New Hampshire. This bill also deletes references to programs that are no longer administered by the Office of Energy and Planning.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT transferring the New Hampshire estuaries project from the department of environmental services to the university of New Hampshire.
Be it Enacted by the Senate and House of Representatives in General Court convened:
20:1 Transfer of Estuaries Project From Department of Environmental Services to University of New Hampshire.
I. Notwithstanding any provision of law to the contrary, all of the functions, powers, duties, and responsibilities of the department of environmental services relating to the New Hampshire estuaries project shall be transferred to the university of New Hampshire. The transfer provided for in this section shall include, but not be limited to, the following personnel from the estuaries project: position numbers 9T003, 9T005, and 8Temp. The transfer provided in this section shall include all of the equipment, books, papers, records, unexpended appropriations, and other available funds in any account or subdivision of an account of the department of environmental services related to the above function and authorized for use by the department of environmental services for said project.
II. All existing rules, statutory responsibilities, regulations, and procedures in effect, in operation, or adopted in or by the New Hampshire estuaries project are transferred to the university of New Hampshire, and are declared in effect and shall continue in effect until rescinded, revised, or amended in accordance with applicable law.
20:2 New Subdivision; Estuaries Project. Amend RSA 187-A by inserting after section 41 the following new subdivision:
New Hampshire Estuaries Project
187-A:42 New Hampshire Estuaries Project. The university of New Hampshire shall administer the New Hampshire estuaries project.
20:3 Office of Energy and Planning; Obsolete References Deleted. Amend RSA 4-C:1, II(i) to read as follows:
(i) Administer the following programs: [the coastal zone management program, the New Hampshire estuaries project, the saltmarsh restorability program, the southeast New Hampshire groundwater sustainability program,] the statewide comprehensive outdoor recreation plan, the national flood insurance program, the land conservation investment program, the scenic and cultural byways system, fuel assistance contracts, and weatherization contracts. The office shall employ necessary personnel to administer these programs.
20:4 Effective Date. This act shall take effect upon its passage.
