AN ACT relative to bail conditions.

ANALYSIS

This bill exempts counsel for the defendant, staff members acting under the direction and supervision of counsel for the defendant, and private investigators hired by counsel for the defendant from certain bail conditions.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to bail conditions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Detention and Sanctions for Default or Breach of Bail Conditions. Amend RSA 597:7-a by inserting after paragraph I-a the following new paragraph:

I-b. No condition of bail, including but not limited to a condition which prohibits contact with any person, shall apply to or restrict counsel for the defendant, or staff members acting under the direction and supervision of counsel for the defendant, or any private investigator who is licensed under RSA 106-F and hired by counsel for the defendant, to the extent they are providing legal representation in connection with any charged or uncharged offense or matter.

2 Effective Date. This act shall take effect January 1, 2006.
