STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT permitting certain hunting activities on one’s own land without a license.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fish and Game; Exceptions to License Requirement. Amend RSA 214:2, I to read as follows:

I. The provisions of RSA 214:1 shall not apply to resident land owners while upon their own land or to the owner's children under 16 years of age when accompanied by the owner or another licensed person 18 years of age or over on such land, to persons fishing in ponds operated and maintained in an aquaculture operation, to persons hunting on a regulated shooting area, to persons under 16 years of age while fishing, to persons under 16 years of age while hunting when accompanied by a licensee 18 years of age or over, or to residents under 16 years of age while trapping when accompanied by a licensee 18 years of age or over. The exception for licensure under this paragraph shall apply to any legal method and manner of taking and to any requirements for special licenses, permits, or tags for any hunting or fishing activity on the resident’s own land.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 179-FN - FISCAL NOTE

AN ACT permitting certain hunting activities on one’s own land without a license.

FISCAL IMPACT:

      The Fish and Game Department states this bill will decrease state fish and game fund revenue by an indeterminable amount in FY 2005 and each year thereafter. There is no fiscal impact on county and local revenue or state, county and local expenditures.

METHODOLOGY:

    The Department indicates this bill provides that persons hunting on their own land who are exempt from hunting license requirements shall also be exempt from other special permit, stamp, and tag requirements. The Department states that the decrease in fish and game revenue is indeterminable because the Department cannot estimate the number of resident landowners that would no longer purchase special permits, stamps or tags including deer (special archery permit at $15, crossbow at $5 and muzzleloader at $15,) pheasant at $15, turkey at $5, bear at $4, waterfowl at $4, and moose application at $10 and moose permit at $100.
