AN ACT relative to the authority of the New Hampshire retirement system to purchase supplies and services.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to the authority of the New Hampshire retirement system to purchase supplies and services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

53:1 New Subparagraph; Administrative Services; Purchase of Supplies; Exemptions; Retirement System Added. Amend RSA 21-I:18, I by inserting after subparagraph (n) the following new subparagraph:

(o) The New Hampshire retirement system shall not be required to make any purchases through the director of plant and property management, unless it wishes to do so. If it does, the executive director shall be required to follow the provisions of this chapter. The retirement system shall make purchases under competitive bidding requirements except when waived by the executive director or his or her authorized agent upon written justification.

53:2 New Paragraph; Retirement System; Board of Trustees; Purchases and Acquisitions. Amend RSA 100-A:14 by inserting after paragraph V the following new paragraph:

V-a. The board of trustees shall have the power to purchase, receive, take by grant, gift, devise, bequest, or otherwise acquire, own, hold, improve, employ, use, and otherwise deal in and with property or any interest therein, whether tangible or intangible, for the purposes of this chapter.

53:3 Effective Date. This act shall take effect 60 days after its passage.
