STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT relative to psychotropic drugs and child protection.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Psychotropic Drugs and Schools. Amend RSA 200 by inserting after section 35 the following new section:
200:35-a Psychotropic Drugs and Schools.
I. Advice regarding the use of psychotropic drugs for any child is the sole responsibility of medical professionals following standard medical practice, testing, and evaluation of the child. No public school personnel shall suggest or recommend use of such medications.
II. No public school shall require a child to take psychotropic drugs as a condition of attending school.
III. The provisions of this section shall not prohibit school personnel from recommending that a child be evaluated by an appropriate health care practitioner, or prohibit school personnel from consulting with such practitioner with the consent of the child’s parents or legal guardian.
2 Effective Date. This act shall take effect 60 days after its passage.

HB 240 FISCAL NOTE
AN ACT relative to psychotropic drugs and child protection.
FISCAL IMPACT:
The Departments of Health and Human Services and Education have determined this bill, as amended by the House (House Amendment #2005-0177h), will have no fiscal impact on state, county and local revenue or expenditures.
METHODOLOGY:
The Department of Health and Human Services states this bill as amended by the House removes the requirement that the Department develop a drug guide, and therefor, has no fiscal impact on state, county and local revenue or expenditures.
