STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to electioneering at polling places.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Preparation of Polling Place; Arrangement; Electioneering. Amend RSA 658:9 by inserting after paragraph III the following new paragraph:

IV. By 5:00 p.m. 3 business days before any election, the moderator shall post at each polling place a description of areas where electioneering activities are permitted and prohibited, pursuant to RSA 659:43, at that polling place.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 339 FISCAL NOTE

AN ACT relative to electioneering at polling places.

FISCAL IMPACT:

      The New Hampshire Municipal Association states this bill, as amended by the House (House Amendment #2005-0411h), may increase local expenditures by an indeterminable amount in FY 2005 and each year thereafter. There will be no fiscal impact on state and county expenditures or state, county and local revenue.

METHODOLOGY:

    The New Hampshire Municipal Association states this would require town moderators to post at each polling place, in advance of elections, a description of areas at that polling place where electioneering activities are permitted and prohibited. Local expenditures may increase depending on how the moderator is compensated in a given town, and the number of polling places in each town. The exact fiscal impact cannot be determined at this time.
