AN ACT relative to notice requirements for public hearings on zoning amendments.

ANALYSIS

This bill requires planning boards to notify the owners of all parcels and all abutting parcels affected by a proposed zoning change before holding a hearing on the change.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to notice requirements for public hearings on zoning amendments.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Notice Requirements for Public Hearing; Notice to Owners of Affected Land and Abutters Required. Amend RSA 675:7 by inserting after paragraph II the following new paragraph:

III. The planning board shall notify by first class mail the owners of all parcels affected by an amendment to a zoning ordinance and the owners of all parcels abutting affected parcels before holding a public hearing under RSA 675:2-4. The notice shall be postmarked at least 7 days prior to the date of the public hearing. This paragraph shall not apply to a proposed zoning amendment that affects the whole town.

2 Effective Date. This act shall take effect January 1, 2006.
