AN ACT relative to filling certain vacancies in multi-member representative districts.

This bill requires that a vacancy occurring in a multi-member representative district occurring before the first meeting of the general court in January be filled by the candidate receiving the next highest vote total, if within 200 votes.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT relative to filling certain vacancies in multi-member representative districts.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Vacancies Among State Representatives; Multi-Member Districts. Amend RSA 661:8 by inserting after paragraph V the following new paragraph:
VI. Notwithstanding the provisions of paragraphs II and III, if a vacancy occurs in a multi-member representative district before the first meeting of the general court in the January following the biennial election, and the returns indicate that a candidate in the elective district for that office who was not declared a representative-elect received a vote total that is within 200 votes of the vote total of any of the candidates declared representative-elect in the elective district, the vacancy shall be filled by the candidate receiving the next highest vote total.
2 Effective Date. This act shall take effect 60 days after its passage.
