AN ACT relative to the Mount Sunapee ski area boundary and lease terms.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to the Mount Sunapee ski area boundary and lease terms.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Mount Sunapee Ski Area Lease; Prohibition on Expansion; Termination. The lease terms for the area of Mount Sunapee state park leased for the Mount Sunapee ski area under RSA 12-A:29-a shall not include or be modified to include any land area, assets, or rights which would expand the ski area operation beyond the boundary for the Mount Sunapee ski area operations in effect during calendar year 2004. The prohibition in this section shall terminate on the reporting date of the study committee established in this act, or on November 1, 2006, whichever is later.

2 Committee Established. There is established a committee to study the Mount Sunapee ski area and issues related to the lease of Mount Sunapee state park under RSA 12-A:29-a.

3 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

4 Duties. The committee shall study the matter of the lease terms of the Mount Sunapee ski area and the proposed expansion of the boundary for the ski area. The study shall include an examination of the impact the ski area and any changes thereto would leave on the region, and an inquiry into the terms or intent of the original grant or transfer of the fund to the state. The committee shall seek input from all neighboring communities and interested parties, and shall be provided assistance from the department of resources and economic development in its study.

5 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

6 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2006.

7 Effective Date. This act shall take effect upon its passage.
