AN ACT relative to competing articles and official ballot voting.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to competing articles and official ballot voting.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Competing Articles. Amend RSA 40:13 by inserting after paragraph XVI the following new paragraph:

XVII. In the event that there are 2 or more competing articles on the ballot and 2 or more of such articles receive the requisite vote to pass, the article that receives the greatest number of votes shall prevail.

2 Effective Date. This act shall take effect 60 days after its passage.

AN ACT relative to competing articles and official ballot voting.

FISCAL IMPACT:

      The New Hampshire Municipal Association and Department of State indicate this bill, as amended by the House (House Amendment #2005-0478h), will have no fiscal impact on state, county, and local revenue or expenditures.

METHODOLOGY:

    The New Hampshire Municipal Association states this bill provides that when two competing articles in an official ballot proceeding receive the minimum number of votes to pass, the article with the most votes shall prevail. The Association states this bill will have no fiscal impact on local revenues or expenditures.

    The Department of State states this bill will have no fiscal impact on their department.
