STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT relative to special wild turkey seasons and permits.
Be it Enacted by the Senate and House of Representatives in General Court convened:
143:1 Special Season Permit Revenues. Amend RSA 206:35-b to read as follows:
206:35-b Wild Turkey License or Permit Revenues. The state treasurer shall establish a separate account to which shall be credited all money collected by the fish and game department from issuance of wild turkey licenses or permits under RSA 214:9, XI, or special season applications and permits under RSA 209:12-a, III. The money in said account shall be nonlapsing and used [only for restoration] exclusively for the implementation of a comprehensive wild turkey management program, including education, research, protection and management of wild turkeys, and is hereby continually appropriated for said purposes. Said funds shall be expended for the purposes of this section as determined by the executive director with the approval of the commission.
143:2 New Paragraph; Wild Turkey; Special Seasons; Permits; Lottery. Amend RSA 209:12-a by inserting after paragraph II the following new paragraph:
III. In addition to wild turkey licenses and permits issued under RSA 214:9, XI, the executive director, with the consent of the commission, may adopt rules under RSA 541-A, relative to issuing permits for a special season for wild turkey, including bag limits, fees for applications and permits, and the establishment of a lottery for awarding the special permits.
143:3 Wild Turkey; Special Season Reference Added. Amend RSA 214:1-c to read as follows:
214:1-c Wild Turkey Permit or License. No person shall at any time hunt, shoot, pursue, kill or take wild turkey in this state without first procuring, in addition to the applicable hunting license required by RSA 214, a permit or license to do so under RSA 214:9, XI, or RSA 209:12-a, III, for the same period.
143:4 Wild Turkey License; Bag Limit. Amend RSA 214:9, XI to read as follows:
XI. If the applicant wishes to hunt wild turkeys, $5, and the fish and game department shall thereupon issue a wild turkey license or permit which shall entitle the licensee to hunt, shoot, kill and take turkey, except by the use of traps. [The bag limit shall be determined by rules adopted by the executive director pursuant to RSA 541-A.]
143:5 Effective Date. This act shall take effect July 1, 2005.
