STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to health standards for food service handlers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Employee Health Screening. Amend RSA 143-A by inserting after section 11 the following new section:

143-A:12 Health Screening of Employees. No person shall be hired to work in a food service establishment unless that person is medically tested for hepatitis. No person whose test is positive for hepatitis shall be hired to work in a food service establishment. The employer shall bear the cost of all such testing.

2 New Paragraph; Rulemaking. Amend RSA 143-A:9 by inserting after paragraph IV-c the following new paragraph:

IV-d. Procedures, forms, and verification of employee health screening pursuant to RSA 143-A:12.

3 Effective Date. This act shall take effect July 1, 2006.
