HB 503-FN-A-LOCAL - FISCAL NOTE

AN ACT relative to distribution of tobacco settlement funds.

FISCAL IMPACT:

The Departments of Justice and Health and Human Services state this bill will have no fiscal impact on state, county and local revenue or expenditures in FY 2006 through FY 2009.

METHODOLOGY:

The Department of Justice indicated the state received $41,860,000 of tobacco settlement revenue in FY 2004, and the Department does not expect the settlement revenue to exceed $43,000,000 per year in FY 2006 though FY 2009.

The Department of Health and Human Services assumed that, in accordance with Chapter 212, Laws of 2000, the first $3,000,000 of the tobacco settlement money received by the state in each year will be deposited in the Tobacco Prevention Fund. The Department assumed this bill will not impact the Tobacco Prevention Fund. The Department further assumed that according to this bill, any tobacco settlement revenue received by the state in excess of $43,000,000 annually would be split evenly between the state and counties starting in FY 2006. The Department agreed with the assumption of the Department of Justice and that there will be no fiscal impact through 2009, if the settlement revenue is not expected to exceed $43,000,000.

The Association of Counties states the fiscal impact on county revenue and expenditures is unknown.
