HOUSE BILL 509
AN ACT relative to election of police chiefs.

This bill allows a certified New Hampshire law enforcement officer to seek and hold the office of elected police chief without being domiciled in the municipality where he or she seeks or holds office.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Five
AN ACT relative to election of police chiefs.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Election of Police Chiefs; Residency Requirements. Amend RSA 41:47 to read as follows:
41:47 Election. Any town at any annual meeting, under an article in the warrant for said meeting, may vote to elect by ballot one or more permanent constables or police chiefs or other police officers for full-time duty in said town and may rescind such action in like manner. No election of such permanent constable or police chief or police officer shall be held until the next succeeding annual meeting after the vote of the town. Any police chief or police officer or constable elected at an annual meeting may serve a one-year, 2-year, or 3-year term, as determined by the town at such annual meeting. Notwithstanding any law to the contrary, a person who is a voter in any New Hampshire town or ward and who is certified by the police standards and training council as a law enforcement officer on the date when he or she files for office may seek and hold the office of elected police chief in any town in the state without being domiciled in the town where he or she seeks or holds office.
2 Effective Date. This act shall take effect 60 days after its passage.
