STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT allowing retired police officers to become teachers without rejoining the state retirement system.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Retirement System Membership; Exception Added. Amend the introductory paragraph of RSA 100-A:3, I(a) to read as follows:

I.(a) Any person who becomes an employee, teacher, permanent policeman or permanent fireman after the date of establishment shall become a member of the retirement system as a condition of employment; except that membership shall be optional in the case of elected officials, officials appointed for fixed terms, unclassified state employees, persons employed as teachers as provided in paragraph X, or those employees of the general court who are eligible for membership in the retirement system. Elected officials and officials appointed for fixed terms shall, however, be eligible for membership in the retirement system only under the following conditions:

2 New Paragraph; Membership; Retired Police Officers Employed as Teachers. Amend RSA 100-A:3 by inserting after paragraph IX the following new paragraph:

X. Membership shall be optional for a person retired under RSA 100-A:5, II for service as a police officer in a town or city police department in this state who becomes employed by a school district in the state as a certified teacher.

3 Effective Date. This act shall take effect 60 days after its passage.

HB 545-FN - FISCAL NOTE

AN ACT allowing retired police officers to become teachers without rejoining the state retirement system.

FISCAL IMPACT:

      The New Hampshire Retirement System states this bill will have no fiscal impact on state, county, and local revenue or expenditures.

METHODOLOGY:

    The System states this bill will remove the requirement for membership in the System for retired police officers who become employed as certified teachers. The System has determined that there will be no cost to the System, since retired police officers would not accrue any additional credited service while employed as a teacher. There will be no administrative costs associated with this legislation.
