AN ACT relative to requirements for debt collection by telephone.

ANALYSIS

This bill requires debt collectors to provide written notice of the debt before contacting a person by telephone. The bill also requires the debt collector to provide additional identification and contact information.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to requirements for debt collection by telephone.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Unfair Debt Collection Practices; Written Notice Required. Amend RSA 358-C:3, I(d) and (e) to read as follows:

(d) Using any written communication which fails to clearly identify the name of the debt collector, the name of the person (as defined in RSA 358-C:1, X) for whom the debt collector is attempting to collect the debt, the amount of the debt, and the debt collector’s business address and telephone number (the foregoing shall not require the name or address of the debt collector or the person for whom the debt collector is attempting to collect the debt to be printed on any envelope containing a communication); or

(e) By placement of phone calls without prior written notice of the debt, meeting the requirements of subparagraph I(d), and without disclosure of the name, location, and telephone number of the individual making the call, contact information for the caller’s supervisor, and the name of the person (as defined in RSA 358-C:1, X) for whom the debt collector is attempting to collect the debt, or by using a fictitious name while engaging in the collection of debts; or

2 Effective Date. This act shall take effect January 1, 2006.
