AN ACT increasing the boat registration fee for public boat access and exotic aquatic weed control.

ANALYSIS

This bill increases the boat registration fee by $5 and allocates $3 of the increase to the public boat access fund and $2 for exotic aquatic weed control.

AN ACT increasing the boat registration fee for public boat access and exotic aquatic weed control.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Increase in Boat Registration Fee for Public Boat Access. Amend RSA 270-E:5, II(d) to read as follows:

(d) [$5] $8 for each registration specified in paragraph I. The surcharge collected under this subparagraph shall be paid into the statewide public boat access fund established under RSA 233-A:13.

2 Increase Boat Registration Fee for Lake Restoration and Preservation Fund. Amend RSA 270-E:5, II(a) to read as follows:

(a) Until December 31, 2007, [$5] $7 for each registration specified in paragraph I. After January 1, 2008, $4 for each registration specified in paragraph I. The fees collected under this subparagraph shall be paid into the lake restoration and preservation fund established under RSA 487:25.

3 Increase in Boat Registration Fee for Statewide Public Boat Access. Amend RSA 233-A:13 to read as follows:

233-A:13 Statewide Public Boat Access Fund Established. There is hereby established a nonlapsing statewide public boat access fund. The [$5] $8 boat registration surcharge collected pursuant to RSA 270-E:5, II(d) and any other public access funds donated to the state shall be placed in this fund. All funds received under this section are continually appropriated to the fish and game department for the purposes of the statewide public boat access program established under this chapter.

4 Increase in Boat Registration Fee for the Control of Exotic Aquatic Weeds. Amend RSA 487:25, I to read as follows:

I. Until December 31, 2007 the fee of [$5] $7 collected under the provisions of RSA 270-E:5, II(a) shall be paid to the director of the division of motor vehicles. After January 1, 2008, the fee of $4 collected under the provisions of RSA 270-E:5, II(a) shall be paid to the director of the division of motor vehicles. The director of the division of motor vehicles shall pay over said fee to the state treasurer who shall keep the fee in a special fund to be expended by the department of environmental services. The department shall use $.50 of the fee for lake restoration and preservation measures, exclusive of exotic aquatic weed control, [$1.50] $3.50 of the fee for the control of exotic aquatic weeds, and, until January 1, 2008, $3 of the fee for the milfoil and other exotic aquatic plants prevention program. The department shall deposit the $3 into a special account within the lake restoration and preservation fund which shall be used to administer the milfoil and other exotic aquatic plants prevention program. The special fund shall be nonlapsing. All funds received under this section are continually appropriated to the department for the purposes of this subdivision.

5 Repeal. The following are repealed:

I. 2002, 201:8, relative to decreasing the boat registration fee for the lakes restoration and preservation fund.

II. 2002, 201:9, relative to the use of the reduced fee in the lakes restoration and preservation fund.

6 Effective Date Changed. Amend 2002:201:10, I to read as follows:

I. [Sections 7-9] Section 7 of this act shall take effect January 1, 2008.

7 Effective Date. This act shall take effect July 1, 2005.

HB 655 FISCAL NOTE

AN ACT increasing the boat registration fee for public boat access and exotic aquatic weed control.

FISCAL IMPACT:

The Departments of Safety, Fish and Game, and Environmental Services indicate state restricted revenue will increase by $510,000 in FY 2006 and each year thereafter. There will be no fiscal impact to state, county and local expenditures or county and local revenue.

METHODOLOGY:

The Departments of Safety, Fish and Game, and Environmental Services state this legislation will increase the boat registration fee by $5. The Department of Safety states that most boat registrations occur in the spring and the increases are distributed into various funds. The statewide public boat access fund receives a $3 increase per registration. The Department of Environmental Services receives from the Director of the Division of Motor Vehicles a $2 increase of the registration fee for the control of exotic aquatic weeds. The Departments estimate 102,000 boats are registered annually.
