AN ACT allowing the president of the National Education Association-New Hampshire to remain a member of the state retirement system.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT allowing the president of the National Education Association-New Hampshire to remain a member of the state retirement system.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Retirement System; Nongovernmental Employees; National Education Association-New Hampshire, President. Amend RSA 100-A by inserting after section 29 the following new section:

100-A:29-a National Education Association-New Hampshire, President. The president of the National Education Association-New Hampshire shall be permitted to continue as a group I teacher member in the retirement system during the person’s term as president, provided the person was a group I teacher member immediately prior to serving as president of the organization. Notwithstanding any provision of RSA 100-A:16 to the contrary, the entire amount of the employer normal contribution, the administrative cost assessment, and any employer accrued liability contribution required pursuant to this section shall be paid by the National Education Association-New Hampshire, and no part shall be paid by the state.

2 Effective Date. This act shall take effect 60 days after its passage.

SB 100-FN - FISCAL NOTE

AN ACT allowing the president of the National Education Association-New Hampshire to remain a member of the state retirement system.

FISCAL IMPACT:

The New Hampshire Retirement System states this bill may have an indeterminable fiscal impact on state, county and local revenue or expenditures in FY 2005 and each year thereafter.

METHODOLOGY:

The New Hampshire Retirement System (NHRS) states this bill would allow the president of the National Education Association-New Hampshire to remain a member of the System if the president was a teacher under the System prior to appointment. The fiscal impact of this bill would be indeterminable because it could result in the loss of governmental plan status for the System by allowing a non-governmental entity to join the plan. This would forfeit the tax status of the plan, which allows the accrual of tax exempt investment returns on behalf of members.
