STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT making technical corrections to certain environmental laws and the small business technical assistance program.

Be it Enacted by the Senate and House of Representatives in General Court convened:

254:1 Small Business Technical Assistance. Amend the introductory paragraph of RSA 21-O:19, I to read as follows:

I. To exercise practical pollution prevention in the field and provide environmental technical assistance to small regulated sources, the department shall:

254:2 New Subparagraphs; Small Business Technical Assistance; Duties. Amend RSA 21-O:19, I by inserting after subparagraph (d) the following new subparagraphs:

(e) Provide small business advocacy and representation on environmentally related activities within the department.

(f) Provide for the review of department outreach, education, and technical assistance activities for small businesses.

254:3 Small Business Technical Assistance. Amend RSA 21-O:19, II(a)(5) to read as follows:

(5) The information is presented in aggregate form with no identification of individual entities in order to develop pollution prevention and technical assistance activities.

254:4 New Subparagraph; Environmental Results Program. Amend RSA 147-A:5, IV by inserting after subparagraph (e) the following new subparagraph:

(f) Small quantity hazardous waste generators that are participants in a department-developed multi-media compliance assurance program referred to as an environmental

results program, or ERP, shall be exempt from this paragraph.

254:5 New Paragraph; Hazardous Waste Management; Fee Exemption Added. Amend RSA 147-A:6-a by inserting after paragraph II the following new paragraph:

III. Small quantity hazardous waste generators that are participants in a department-developed multi-media compliance assurance program referred to as an environmental results program, or ERP, shall be exempt from this notification fee.

254:6 Effective Date. This act shall take effect 60 days after its passage.
