STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Five

AN ACT relative to increased funding for publication of certain materials by the department of environmental services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

220:1 Department of Environmental Services; Revolving Fund Increase. Amend the introductory paragraph and paragraph I of RSA 21-O:1-a to read as follows:

21-O:1-a Revolving Fund. In order to enhance its ability to provide education and training assistance to municipalities, regional agencies, and persons subject to regulation by the department, a nonlapsing revolving fund, which shall not exceed [$20,000] $30,000 on June 30 of each year, shall be established in the department of environmental services. Any amounts in excess of [$20,000] $30,000 on June 30 of each year shall be deposited in the general fund as unrestricted revenue. The moneys in this fund shall be used for the purposes of:

I. [Printing] Producing materials for distribution. A reasonable charge shall be established for each copy of a document. This charge shall be only in the amount necessary to pay the cost of producing such document in paper, electronic, or other media. The department of environmental services shall first request the department of corrections to perform the [printing] production functions required under this paragraph. If the department of corrections is unable to [print] produce the materials required for distribution, the department of environmental services may then request any other state-owned [printing] facility to perform this function, and if all other state-owned [printing] facilities are unable to perform this request, the department of environmental services may then request public bids from privately owned [printing] facilities to [print] produce the materials.

220:2 Effective Date. This act shall take effect July 1, 2005.
