STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT requiring equestrian helmets for first-time riders.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Equestrian Helmets. Amend RSA by inserting after chapter 167-D the following new chapter:

CHAPTER 167-E

EQUESTRIAN HELMETS

167-E:1 Definitions. In this chapter:

I. “Horse” includes a horse, pony, mule, or hinny.

II. “Horse provider” includes any person, firm, corporation or other legal entity hiring or renting out horses for riding or providing training in the riding of horses for consideration.

167-E:2 Helmets Required. Every horse provider shall provide a protective helmet to a first-time rider at no cost beyond the rental fee. The helmet shall be certified by the Safety Equipment Institute and shall meet or exceed ASTM F1163 established by American Society for Test and Materials.

167-E:3 Penalty. Any horse provider who knowingly violates this section shall be subject to a civil penalty not to exceed $50 for each such violation.

2 Effective Date. This act shall take effect June 30, 2006.
