STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT establishing a commission to study the care needs of medically-fragile students in the school system.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the care needs of medically-fragile students in the school system.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Two members of the senate, appointed by the president of the senate.

(c) The commissioner of the department of education, or designee.

(d) One member appointed by the New Hampshire School Nurses Association.

(e) One member appointed by the New Hampshire chapter of the National Education Association.

(f) One member appointed by the Council for Children and Adolescents with Chronic Health Conditions.

(g) One member appointed by the pharmacy board.

(h) One member appointed by the commissioner of the department of health and human services.

(i) One member appointed by the New Hampshire Pediatric Society.

(j) One member appointed by the New Hampshire School Administration Association.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall study the care needs of medically-fragile students in the school system. The commission shall investigate the challenges of school personnel and families in addressing medical needs of medically-fragile children in the school community, including, but not limited to medication administration and treatment interventions. The goal of the commission shall be to maintain an environment where children can learn to manage their chronic disease in a supportive setting.

4 Chairperson; Meetings. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. 5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before June 1, 2007.

6 Effective Date. This act shall take effect upon its passage.
