AN ACT relative to the time required between mandatory shifts or other work periods.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Day’s Work Defined; Time Required Between Work Periods Added. Amend RSA 275:30 to read as follows:
275:30 Day’s Work Defined.
I. In all contracts relating to labor, 8 hours’ actual labor shall be taken to be a day’s work unless otherwise agreed by the parties. This provision shall not apply to classes of labor for which the law provides day limits.
II. No employer shall require any employee, whether hourly or salaried, to work sooner than 10 hours after the ending of the employee’s most recent period of work. An employee may volunteer to return to work sooner than 10 hours after his or her last period of work or may refuse to waive the 10-hour requirement without consequences. Each instance of an employee’s voluntary waiver of the 10-hour rest period shall be reported to the labor commissioner. Whoever violates this section shall be fined $50 for each occurrence.
2 Effective Date. This act shall take effect January 1, 2007.
