AN ACT creating a violation for failure to pay a highway toll.

ANALYSIS

This bill makes failure to pay a highway toll a violation for vehicles that pass through a toll facility or any lane of a toll facility that is not equipped with an electronic toll monitoring system and clarifies that the administrative procedure for toll evasion applies to all other vehicles that evade a toll.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT creating a violation for failure to pay a highway toll.

Be it Enacted by the Senate and House of Representatives in General Court convened:

116:1 New Section; Failure to Pay a Highway Toll. Amend RSA 236 by inserting after section 31 the following new section:

236:31-a Failure to Pay a Highway Toll. Any person passing through a toll facility or any lane of a toll facility that is not equipped with an electronic toll collection monitoring system who fails, neglects, or refuses to pay the toll or charge for the use of any bridge, highway, or part thereof shall be guilty of a violation. In all other cases, RSA 236:31 shall apply.

116:2 Effective Date. This act shall take effect upon its passage.
