HOUSE BILL 1159
AN ACT relative to procedures for certain court ordered out-of-district placements.

This bill requires that the court review all information by a school district’s special education teachers and educational specialists relevant to the case under consideration.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Six
AN ACT relative to procedures for certain court ordered out-of-district placements.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraph; Special Education; Liability for Educationally Disabled Children in Certain Court Ordered Placements. Amend RSA 186-C:19-b, I by inserting after subparagraph (b) the following new subparagraph:
(c) Prior to ordering any out-of-district placement under this section, the court shall review all information provided by a school district’s special education teachers and educational specialists relevant to the case under consideration.
2 Effective Date. This act shall take effect 60 days after its passage.
