STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to highway construction safety.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Definitions; Place of Employment; Highway Construction Site Added. Amend RSA 277:1-b, IV to read as follows:

IV. “Place of employment” means all buildings, offices, highway construction sites, or other sites owned or leased by the state or by any political subdivision of the state. “Place of employment” includes all buildings, sheds, structures or places used in connection with employee activity at a place of employment.

2 Safeguards; Highway Construction Sites. Amend RSA 277:11 to read as follows:

277:11 Safeguards.

I. Whenever the nature or condition of any such place of employment, or the machinery or other appliances therein, are such as to render work therein or in proximity thereto dangerous to the safety or health of employees, it shall be the duty of the employer to provide and maintain such safeguards, safety devices, appliances and lighting facilities, and to do such other things as may be reasonably necessary and practicable to lessen the dangers of such employment.

II. In addition to the use of signs or warning flags, any employer who is constructing a highway shall require and provide reflective or other high-visibility clothing for at least one employee at the highway construction site at all times. The clothing shall be such that it may be seen regardless of the direction in which the employee is facing, time of day, or weather conditions. The clothing may consist of gloves, hats, vests, or other visible clothing items. For purposes of this paragraph, employer shall also include any contractor or subcontractor working at a highway construction site for the state or any of its political subdivisions.

3 Effective Date. This act shall take effect 60 days after its passage.
