AN ACT relative to the violation of protective orders.

This bill provides that the defendant shall not be charged with violating a protective order if the plaintiff or victim of domestic violence initiated contact with the defendant.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Six
AN ACT relative to the violation of protective orders.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Violation of Protective Order; Penalty; No Criminal Liability if Contact Initiated by Plaintiff. Amend RSA 173-B:9 by inserting after paragraph III the following new paragraph:
III-a. Notwithstanding paragraph I and III, if the plaintiff or victim of domestic violence initiates contact with the defendant, the defendant shall not be charged with violating the protective order.
2 Effective Date. This act shall take effect January 1, 2006.
