AN ACT requiring out-of-state owners to register unflyable aircraft.

This bill requires the annual registration of unflyable aircraft by out-of-state owners and establishes a registration fee.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT requiring out-of-state owners to register unflyable aircraft.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; New Hampshire Aeronautics Act; Fees. Amend RSA 422:31 by inserting after paragraph IX the following new paragraph:

X. A registration fee for each aircraft owned by a nonresident, which is in an unflyable condition and which will remain in such condition throughout the registration year, $15:

(a) If a request for registration as an unflyable aircraft is submitted in writing to the department; and

(b) If the department finds the information in the request is sufficient justification for department approval of the unflyable registration.

2 New Paragraph; New Hampshire Aeronautics Act; Exceptions. Amend RSA 422:32 by inserting after paragraph V the following new paragraph:

VI. A registration fee for each aircraft owned by a resident of this state which is in an unflyable condition and which will remain in such condition throughout the registration year:

(a) If a request for registration as an unflyable aircraft is submitted in writing to the department; and

(b) If the department finds the information in the request is sufficient justification for department approval of the unflyable registration.

3 Repeal. RSA 422:22, VI, relative to an exception from registration for unflyable aircraft, is repealed.

4 Effective Date. This act shall take effect July 1, 2006.

AN ACT requiring out-of-state owners to register unflyable aircraft.

FISCAL IMPACT:

    The Legislative Budget Assistant has determined that this legislation has a total fiscal impact of less than $10,000 in each of the fiscal years 2006 through 2010.
