STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT authorizing vehicle licensing, title, and registration recovery fees by motor vehicle rental companies.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Vehicle Licensing, Title, and Registration Recovery Fee. Amend RSA 261 by inserting after section 31 the following new section:

261:31-a Vehicle Licensing, Title, and Registration Recovery Fee. A company engaged in the rental of motor vehicles may charge its customers a vehicle licensing, title, and registration recovery fee, which shall represent a portion of the company’s estimated cost of registering, titling, and licensing its vehicles in New Hampshire. If charged, the fee shall be separately stated and identified as such on the rental agreement. The fee shall be estimated by the rental company based upon the estimated annual registration, title, and licensing costs for its rental fleet in the state of New Hampshire. Fees collected in excess of the actual amount of the licensing, titling, and registration costs incurred by the rental company shall be retained by the rental company and applied towards the recovery of next year’s licensing, titling, and registration costs. In such event, the fee charged by the rental company for the next year shall be estimated in good faith and shall be adjusted to take into account the excess amount collected from the prior year.

2 Effective Date. This act shall take effect January 1, 2007.
