This bill allows the commissioner of the department of safety to enter into a memorandum of understanding with the United States Customs and Immigration Services, Department of Homeland Security for the purpose of allowing state, county, and local law enforcement officers to be trained to assist in enforcing federal immigration law. The bill also makes an appropriation for the purposes of the bill.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Six
AN ACT authorizing a memorandum of understanding between state and local law enforcement and the United States Department of Homeland Security regarding immigration enforcement and making an appropriation therefor.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Department of Safety; Duties of Commissioner. Amend RSA 21-P:4 by inserting after paragraph XII the following new paragraph:
XIII. Have the discretion to enter into a memorandum of understanding with the United States Customs and Immigration Services, Department of Homeland Security for the purpose of training state, county, and local law enforcement officers to assist in enforcing federal immigration law. The memorandum shall require the commissioners of the departments of safety and corrections to conduct an inventory of the state’s correctional facilities to determine the number of illegal aliens which could be lawfully housed upon detention and during deportation proceedings.
2 New Subdivision; Department of Safety; Immigration and Customs Enforcement Training Fund. Amend RSA 21-P by inserting after section 52 the following new subdivision:
Immigration and Customs Enforcement Training Fund
21-P:53 Immigration and Customs Enforcement Training Fund Established. There is hereby established an immigration and customs enforcement training fund for the purpose of training state, county, and local law enforcement officers to assist in enforcing federal immigration law. The fund shall be administered by the commissioner of the department of safety. Moneys in the fund shall be expended as equally as possible on training for state, county, and local law enforcement officers. A maximum of $1,000 per law enforcement official may be expended from this fund for training. Moneys in the fund shall be nonlapsing and continually appropriated to the department of safety for the purposes of this section.
3 New Subparagraph; State Treasurer; Application of Receipts. Amend RSA 6:12, I(b) by inserting after subparagraph (242) the following new subparagraph:
(243) Moneys appropriated to the immigration and customs enforcement training fund established in RSA 21-P:53.
4 Appropriation; Department of Safety. The sum of $50,000 for the fiscal year ending June 30, 2006 is hereby appropriated to the department of safety for the purpose of training state, county, and local law enforcement officers. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
5 Effective Date. This act shall take effect July 1, 2006.

HB 1666-FN-A - FISCAL NOTE
AN ACT authorizing a memorandum of understanding between state and local law enforcement and the United Stated Department of Homeland Security regarding immigration enforcement and making an appropriation therefor.
FISCAL IMPACT:
The Department of Safety has determined this bill will increase state general fund and restricted fund expenditures by $50,000 in FY 2007. There will be no fiscal impact on county and local expenditures or state, county and local revenue.
This bill appropriates $50,000 in FY 2006 from the general fund to the Department of Safety for the purposes of this act.
METHODOLOGY:
The Department stated this bill intends to allow the Commissioner to enter into a memorandum of understanding with the US Customs and Immigration Services, Department of Homeland Security for the purpose of allowing state, county, and local law enforcement officers to be trained to assist in enforcing federal immigration law. This bill establishes and funds with a $50,000 general fund appropriation an “Immigration and Customs Enforcement Training Fund” to be administered by the Department of Safety. The Department assumes that all of the $50,000 from the training fund would be expended to train state, county and local law enforcement officers.
