STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

A RESOLUTION condemning protests and disruptions of military funerals and memorial services.

Whereas, the brave men and women of our military who have given their lives in service to our country deserve to be buried peacefully and with dignity; and

Whereas, the grieving families of soldiers who have died while honorably serving the United States should not be subject to disrespect and further distress; and

Whereas, the New Hampshire house of representatives recognizes that the exercise of a person’s right to voice his or her objection to the involvement of the United States in war must be balanced against other persons’ rights to personal safety during a funeral, burial, memorial service, or funeral procession of a person who has served in a war; and

Whereas, the United States House of Representatives has recently passed H.R. 5037, the Respect for America’s Fallen Heroes Act, which prohibits demonstrations at national cemeteries, and restricts any demonstration during a funeral or memorial service at a national cemetery within 500 feet of the funeral or service and 60 minutes before and after the funeral or service; and

Whereas, many states have enacted or are considering enacting into law legislation either banning or restricting demonstrations at funerals; now, therefore, be it

Resolved by the House of Representatives:

That the New Hampshire house of representatives condemns protests and disruptions of military funerals and memorial services; and

That the New Hampshire house of representatives urges the United States Senate to adopt H.R. 5037; and

That the New Hampshire house of representatives should consider legislation banning or restricting demonstrations at funerals and memorial services during its 2007 legislative session; and

That the house clerk transmit copies of this resolution to the President of the United States Senate and to the members of the New Hampshire congressional delegation.
