STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT allowing the fish and game department to conduct an annual auction of moose hunting permits.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Moose Permit Auction. Amend RSA 208 by inserting after section 1-a the following new section:

208:1-aa Moose Permit Auction. The executive director may issue not more than 3 moose hunting permits each year awarded through public auction to the applicant who submits the highest bid. A person who applies for and bids for a moose hunting permit under this section is subject to the requirements for moose hunting in RSA 208:1-a and related rules.

I. An eligible person wishing to apply for a permit under this section shall submit a written application in such form as the executive director may require. The application shall be accompanied by a bidding fee of $25, which, except as otherwise provided in paragraph II, is nonrefundable. The minimum successful bid shall be $5,000.

II. An eligible person may apply for a moose hunting permit both through the public lottery established under RSA 208:1-a, II and II-a and in accordance with this section. If a person is selected to receive a moose hunting permit as a result of the moose permit lottery, that person is no longer eligible to obtain a permit under this section for the current season and the bidding fee submitted by that person shall be refunded. A moose hunting permit awarded under this section shall not affect a person’s accumulated points and continuing participation in the bonus point system under RSA 208:1-a, II-a.

III. A moose hunting permit issued under this section shall be valid in the moose management district designated by the permittee. This designation shall be made within 30 days after the permit is awarded. A person who is awarded a moose hunting permit under this section may select a subpermittee to participate in the moose hunt.

IV. The executive director may enter into a contract with a suitable organization to advertise this process of issuing permits, auction the permits, and collect and pay revenues to the department.

V. All revenues received by the department under this section, shall be deposited in the fish and game fund.

VI. Except as otherwise provided, the provisions of this title relating to eligibility, licensing, and method and manner of taking moose are applicable to the hunting of moose with a permit awarded under this section.

VII. The executive director may adopt rules pursuant to RSA 541-A as necessary for the required forms, proper administration, implementation, enforcement and interpretation of this section.

2 Prospective Repeal. RSA 208:1-aa, relative to the moose permit auction, is repealed.

3 Effective Date.

I. Section 2 of this act shall take effect July 1, 2012.

II. The remainder of this act shall take effect 60 days after its passage.
