STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to contracts with illegal aliens.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Contracts with Illegal Aliens. Amend RSA by inserting after chapter 359-I the following new chapter:

CHAPTER 359-J

CONTRACTS WITH ILLEGAL ALIENS

359-J:1 Contracts with Illegal Aliens Unenforceable. All contracts, including but not limited to leases of real and personal property, loans, and insurance contracts, entered into with any illegal alien shall be unenforceable.

2 General Definitions. Amend RSA 382-A:1-201(12) to read as follows:

(12) “Contract,” as distinguished from “agreement,” means the total legal obligation that results from the parties’ agreement as determined by this chapter as supplemented by any other applicable laws. “Contract” shall not include contracts with illegal aliens, which are unenforceable in this state.

2 Effective Date. This act shall take effect January 1, 2009.
