HOUSE BILL 1169
AN ACT relative to parental approval of a student’s participation in human sexuality instruction in public schools.

This bill requires a school district to obtain the written consent of a parent or guardian prior to providing human sexuality instruction to a pupil.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT relative to parental approval of a student’s participation in human sexuality instruction in public schools.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; School Boards; Instruction in Human Sexuality. Amend RSA 189 by inserting after section 11-b the following new section:
189:11-c Instruction in Human Sexuality; Written Consent Required. No human sexuality instruction shall be provided to a pupil without the written consent of the pupil’s parent or guardian. Such request for consent shall include a description of the basic content of the school district’s course in human sexuality, and shall be provided to a parent or guardian separately from any other written school notices or forms at least 14 days before the date on which the human sexuality instruction begins.
2 Effective Date. This act shall take effect 60 days after its passage.
