STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT establishing a commission to study air quality issues in public school buildings.

Be it Enacted by the Senate and House of Representatives in General Court convened:

242:1 Commission Established. There is established a commission to study air quality issues in public school buildings.

242:2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) One member from the department of environmental services with expertise in air quality issues, appointed by the commissioner of the department of environmental services.

(d) One member from the department of education with expertise in school building issues, appointed by the commissioner of the department of education.

(e) One member from the department of health and human services, division of public health services, with experience in indoor air quality and respiratory health issues, appointed by the commissioner of health and human services.

(f) One member from the New Hampshire Health Officers’ Association, appointed by that association.

(g) Up to 3 members from the public knowledgeable in the areas of school health advocacy and school building air quality, appointed by the governor.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

242:3 Duties.

I. The commission shall study air quality issues in public school buildings, and the feasibility of implementing air quality standards and performing regular air quality inspections in public school buildings.

II. The commission shall investigate and make recommendations regarding successful, cost-effective, alternative initiatives developed to address air quality issues in public school buildings elsewhere in New Hampshire and in other states.

III. The commission may solicit, accept, and expend any grants, gifts, or donations from any source, provided such grants, gifts, or donations shall be used for the purpose of retaining consultants with relevant information and expertise as deemed necessary by the commission.

242:4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Five members of the commission shall constitute a quorum.

242:5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2009.

242:6 Effective Date. This act shall take effect upon its passage.
