STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to reimbursement rates for foster care respite providers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Residential Care for Children; Respite Care. Amend RSA 170-E by inserting after section 49 the following new section:

170-E:49-a Respite Care. The commissioner shall authorize payment for respite care services pursuant to a court order or voluntary service agreement between the department and family. Respite care services shall be provided by a foster family home or child-placing agency licensed under this chapter and may be provided to children who are living with parents or other relatives or who are in out-of-home settings. Reimbursement rates for respite care shall reflect the average cost to deliver services and shall be reviewed and, if necessary, revised at least once every 2 years. The department shall adopt rules, pursuant to RSA 541-A, relative to eligibility for respite care, the duration and scope of respite care services, and reimbursement rates for respite care services.

2 Effective Date. This act shall take effect 60 days after its passage.
