AN ACT allowing county commissioners to be interim administrators of the county nursing home.

ANALYSIS

This bill provides that during an interim when a county nursing home is without a licensed administrator, the county commissioners may operate and administer the facility for 90 days or until a licensed administrator is employed.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT allowing county commissioners to be interim administrators of the county nursing home.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Nursing Home Administrators; Exception for Interim Administration of County Nursing Home. Amend RSA 151-A:2 to read as follows:

151-A:2 Nursing Home Administrator License Required.

I. Except as provided in paragraph II, no nursing home in the state may operate unless it is under the supervision of an administrator who holds a currently valid nursing home administrator’s license and registration issued pursuant to this chapter.

II. If a county nursing home is temporarily without a licensed nursing home administrator, the county commissioners shall be authorized to operate and administer the county nursing home for a period not to exceed 90 days or until a licensed nursing home administrator is employed. The county commissioners shall consult with the director of nursing of the county nursing home for all matters concerning care and may consult with licensed administrators of other county nursing homes for matters concerning the operation and administration of the facility.

III. No person shall practice or offer to practice nursing home administration in this state or use any title, sign, card or device to indicate that such person is a nursing home administrator unless such person is duly licensed and registered as a nursing home administrator as required by this chapter. However, nothing in this chapter or the rules adopted under this chapter shall be construed to require an applicant for a license as a nursing home administrator who is certified by a recognized church or religious denomination which teaches reliance on spiritual means alone for healing as having been approved to administer institutions certified by such church or denomination for the care and treatment of the sick in accordance with its teachings, to demonstrate proficiency in any medical techniques or to meet any medical educational qualifications or medical standards not in accord with the remedial care and treatment provided in such institutions.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1449-FN-LOCAL - FISCAL NOTE

AN ACT allowing county commissioners to be interim administrators of the county nursing home.

FISCAL IMPACT:

      The Association of Counties states this bill may decrease county expenditures by an indeterminable amount in FY 2008 and each year thereafter. This bill would have no fiscal impact on state, county, and local revenue, or state and local expenditures.

METHODOLOGY:

    The Association of Counties states this bill would allow for the county commissioners to run the county nursing home for up to 90 days during a period when a nursing home is temporarily without a licensed nursing home administrator. Current law requires a licensed nursing home administrator on site operating the facility. In cases where a county is temporarily without a licensed administrator, this bill could reduce county expenditures otherwise paid to a temporary administrator. The exact fiscal impact cannot be determined at this time.

    The Department of Health and Human Services states this bill will have no fiscal impact on the Department.
