STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT allowing dental hygienists to engage in independent practice.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Board of Dental Examiners; Rulemaking; Dental Hygienists. Amend RSA 317-A:12 by inserting after paragraph XI the following new paragraph:

XI-a. The independent practice of dental hygiene by licensed dental hygienists.

2 Dental Hygienists; Independent Practice. RSA 317-A:21-d is repealed and reenacted to read as follows:

317-A:21-d Dental Hygienists; Independent Practice; Advisory Committee.

I. A dental hygienist licensed by the board may engage in independent practice of dental hygiene according to procedures and requirements in rules adopted by the board.

II. A dental hygienist in independent practice may maintain a collaborative relationship with a dentist as provided in rules adopted by the board. A dental hygienist in independent practice may be directly reimbursed for services by third party payers or other entities.

III. There is established an advisory committee on independent practice of dental hygiene, consisting of the 2 dental hygienist members of the board and 3 additional dental hygienists appointed by the board for 5-year terms. The advisory committee shall recommend rules for the independent practice of dental hygiene and provide ongoing consultation concerning the practice.

3 Repeal. RSA 317-A:21-c, III, relative to requirement of supervision by a dentist, is repealed.

4 Effective Date. This act shall take effect 60 days after its passage.
