SENATE BILL 531
AN ACT relative to making capital appropriations for the Hillsborough north superior court and the Manchester district court family division and lapsing certain prior capital appropriations, and relative to the venue for civil and criminal cases in Hillsborough county.
The bill makes capital appropriations for the renovation, construction, and design of the Manchester district court - family division and the design of the Hillsborough County north superior court. The bill also lapses certain unencumbered balances from prior capital appropriations.
The bill also extends the venue for civil and criminal cases where trials are scheduled at Hillsborough north superior court to the entire county of Hillsborough, when the Hillsborough north superior court is closed for renovations.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT relative to making capital appropriations for the Hillsborough north superior court and the Manchester district court family division and lapsing certain prior capital appropriations, and relative to the venue for civil and criminal cases in Hillsborough county.
Be it Enacted by the Senate and House of Representatives in General Court convened:
385:1 Capital Appropriation; Department of Administrative Services, Bureau of Court Facilities; Manchester District Court - Family Division.
I. The sum of $2,565,000 is hereby appropriated to the department of administrative services, bureau of court facilities, for the purpose of the renovation, construction, and design of the Manchester district court - family division.
II. The sum of $1,342,000 is hereby appropriated to the department of administrative services, bureau of court facilities, for the purpose of the design of the Hillsborough County superior court - north.
III. To provide funds for the appropriations made in paragraphs I and II, the state treasurer is hereby authorized to borrow upon the credit of the state not exceeding the sum of $3,907,000 and for said purpose may issue bonds and notes in the name of and on behalf of the state of New Hampshire in accordance with RSA 6-A. Payments of principal and interest on the bonds and notes shall be made from the general fund of the state.
IV. All contracts and projects and plans and specifications therefor for the projects authorized in this section shall be awarded in accordance with the provisions of RSA 21-I.
V. The appropriations in paragraphs I and II of this section shall not lapse until July 1, 2011.
385:2 Lapse of Prior Capital Project Balances.
I. The sum of $19,619 from the unencumbered balance of the appropriation to the department of administrative services in 2003, 240:1, II, B, 12 as extended by 2005, 259:25, XIV and 2007, 264:29, XII, for Site and Design Parking Garage - Executive/Legislative, shall lapse on the effective date of this section.
II. The sum of $38,055 from the unencumbered balance of the appropriation to the department of administrative services in 2005, 259:1, II, B, 4, as extended by 2007, 264:29, XV, for All State Owned Facilities - Emergency Repairs, shall lapse on the effective date of this section.
III. The sum of $47,260 from the unencumbered balance of the appropriation to the department of administrative services in 2005, 259:1, II, B, 10, as extended by 2007, 264:29, XVII, for Legislative Office Building - Replace Chiller, shall lapse on the effective date of this section.
IV. The sum of $545,310 from the unencumbered balance of the appropriation to the department of health and human services in 2005, 259:1, VII, C, as extended by 2007, 264:29, LIV, for State Office Park South - Electrical System Upgrade, shall lapse on the effective date of this section.
V. The sum of $1,356,756 from the unencumbered balance of the appropriation to the university system of New Hampshire in 2005, 259:2, III, as amended by 2007, 264:25, for the renovation of the stadium and athletic complex on the UNH campus shall lapse on the effective date of this section.
VI. The sum of $1,900,000 from the unencumbered balance of the appropriation to the department of administrative services in 2007, 264:1, II, A, 1, for Hillsborough County North -Asbestos Abatement, shall lapse on the effective date of this section.
385:3 New Paragraphs; Venue and Jury Selection for Criminal and Civil Cases; Hillsborough County. Amend RSA 496:1 by inserting after paragraph II the following new paragraphs:
III. For offenses committed on or after the effective date of this paragraph in the county of Hillsborough, where the trial is scheduled at a time when the courthouse for the northern judicial district of the county of Hillsborough is closed for renovations, the judicial district for purposes of part I, article 17 of the New Hampshire Constitution, as well as for jury selection pursuant to RSA 500-A:2, shall be the entire county of Hillsborough.
IV. For civil jury trials in the county of Hillsborough, where the trial is scheduled at a time when the courthouse for the northern judicial district of the county of Hillsborough is closed for renovations, the judicial district for purposes of jury selection pursuant to RSA 500-A:2, shall be the entire county of Hillsborough.
385:4 Effective Date. This act shall take effect upon its passage.
