AN ACT exempting tier I offenders from inclusion in the department of safety’s public list of registered offenders.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT exempting tier I offenders from inclusion in the department of safety’s public list of registered offenders.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Registration of Criminal Offenders; Availability of Information. Amend the introductory paragraph in RSA 651-B:7, III(a) to read as follows:
III.(a) The division shall maintain a separate public list of all [tier I,] tier II[,] and tier III offenders who are required to register as a result of an offense against a child, any offenders about whom the division receives notice pursuant to RSA 651-B:4, V that will be required to register as a result of an offense against children, and any offender who is required to register for more than one sexual offense or offense against a child. The public list shall include all of the following information:
2 Repeal. RSA 651-B:6, III(a)(3), relative to the procedure for tier I offenders to petition for removal from the public list, is repealed.
3 Applicability. This act shall apply to any person who is required to register, as defined in RSA 651-B:1, XI, as a tier I offender on or after the effective date of this act.
4 Effective Date. This act shall take effect January 1, 2010.
