STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to addresses on motor vehicle registrations.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Sections; Re-Registration by Residents Without a Permanent Street Address. Amend RSA 261 by inserting after section 52-a the following new sections:

261:52-b Re-Registration by Residents Temporarily Traveling out of the State. Residents who are without a permanent street address at the time of re-registration because they are traveling outside of the state in recreational vehicles for a period of up to 2 years may renew a vehicle registration by completing a written attestation of residency and providing a letter from an adult property-owning resident of the municipality who agrees to act as the person’s mailing address for purposes of contact by the department. Residency for the purposes of this section shall be defined as intention to return to the municipality after a period of time not to exceed 2 years.

261:52-c Re-Registration by Residents Without a Permanent Street Address.

I A resident who is homeless without a permanent street address at the time of re-registration may register a vehicle by certifying to the department in writing that he or she is currently resident in the town and by providing a letter signed by an authorized representative of a social service organization or agency qualified under section 501(c)(3) of the Internal Revenue Code stating that the person is authorized to use the mailing address of the organization or agency for purposes of contact by the department.

II. A certification of current residency and a current letter authorizing the use of the mailing address of a qualified social service agency or organization shall be submitted to the department in connection with every registration made under this section. The director shall provide the form on which the certification is made.

III. Residency for the purposes of this section shall be defined as the expressed intention to continue to reside in the municipality.

261:52-d Indication of Contact Address. A re-registration application completed under RSA 261:52-b or RSA 261:52-c shall contain an indication that the address provided is not the physical residence of the registrant but a mailing address for purposes of contact.

2 Registration Forms. The division of motor vehicles of the department of safety shall modify vehicle registration forms to allow for the use of mailing addresses which are not residential addresses in the case of residents re-registering a vehicle under RSA 261:52-b or RSA 261:52-c.

3 Effective Date. This act shall take effect January 1, 2010.

HB 112 FISCAL NOTE

AN ACT relative to addresses on motor vehicle registrations.

FISCAL IMPACT:

    The Department of Safety states this bill, as amended by the Senate (Amendment #2009-1596s), will increase state highway fund and local expenditures by an indeterminable amount in FY 2010. This bill will have no fiscal impact on state, county and local revenues or county expenditures.

METHODOLOGY:

    This bill establishes requirements for vehicle registration by persons without a permanent street address at the time of re-registration. The Department of Safety states this bill will increase state highway fund expenditures by amounts associated with programming changes that would be required to be made in order to implement the proposed legislation. Although the costs associated with the necessary programming changes is indeterminable, the Department notes that the necessary changes could require as much as 320 hours of programming at $150 per hour costing approximately $48,000 in FY 2010.

    The Department also notes that there would be an indeterminable increase in local expenditures resulting from the additional programming changes that would be required at the 220 municipal agent locations in order to implement the proposed legislation.

    This bill does not contain an appropriation.
