AN ACT allowing firefighters, police officers, emergency medical technicians, and other public safety officers to recover damages or benefits for negligently-caused injuries.

ANALYSIS

This bill provides that firefighters, emergency medical technicians (EMTs), police officers, and other public safety officers shall not have their right to compensation for wrongfully or negligently caused injuries denied or limited by the “fireman’s rule,” or any other similar rights-depriving rule.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT allowing firefighters, police officers, emergency medical technicians, and other public safety officers to recover damages or benefits for negligently-caused injuries.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Liability of Third Person. Amend RSA 281-A:13 by inserting after paragraph VI the following new paragraph:

VII. Firefighters, emergency medical technicians (EMTs), police officers, and other public safety officers shall not have their right to compensation for wrongfully or negligently caused injuries, including their right to uninsured motorist insurance benefits, denied or limited by the “fireman’s rule,” or any similar rights-depriving rule.

2 Effective Date. This act shall take effect January 1, 2010.
