AN ACT creating an exception from the registration requirement for certain nonviolent offenders.

ANALYSIS

This bill creates an exception from the registration requirement for persons convicted of nonviolent sexual assault involving a victim who was at least 13 years of age but under 16 years of age.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT creating an exception from the registration requirement for certain nonviolent offenders.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Sexual Assault and Related Offenses; Sexual Assault. Amend RSA 632-A:4, II to read as follows:

II.(a) A person found guilty under subparagraph I(c) of this section shall not be required to register as a sexual offender under RSA 651-B.

(b) In the absence of any of the circumstances set forth in RSA 632-A:2, and notwithstanding RSA 651-B:1, VII(b), a person found guilty under subparagraph I(b) of this section shall not be required to register as a sexual offender under RSA 651-B.

2 Effective Date. This act shall take effect January 1, 2010.
