STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT relative to payment for tobacco products purchased by retailers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Payments by Retailers for Tobacco Products Purchased From Wholesalers. Amend RSA 78 by inserting after section 12-e the following new section:
78:12-f Payments by Retailers for Tobacco Products Purchased. Retailers shall pay wholesalers for the cost of tobacco products purchased within 10 days of such purchase. The commissioner shall suspend or revoke the license of any retailer who violates the provisions of this section.
2 Effective Date. This act shall take effect July 1, 2009.

HB 227-FN - FISCAL NOTE
AN ACT relative to payment for tobacco products purchased by retailers.
FISCAL IMPACT:
The Department of Revenue Administration states this bill will increase state expenditures by an indeterminable amount and may have an indeterminable impact on state revenues in FY 2010 and each year thereafter. This bill will have no effect on county or local revenues or expenditures.
METHODOLOGY:
The Department of Revenue Administration states this bill will require retailers to pay wholesalers for the cost of tobacco products within 10 days of such purchase and will require the Commissioner to suspend or revoke the license of any retailers who violates these terms. The Department states this bill will increase state expenditures by an indeterminable amount due to the additional administrative workload the Department would bear. The Department would be required to track collections for tobacco wholesalers to ensure payment by retailers within 10 days, suspend and revoke licenses of retailers who are not in compliance, attend hearings and reinstate licenses. The Department also states there may be an impact on state revenue, but that impact is indeterminable.
