STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the use of New Hampshire talent in state promotional initiatives.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 State Promotional Initiatives. Amend RSA 21-Q:1 to read as follows:

21-Q:1 State Promotional Initiatives.

I. In consultation with the New Hampshire film and television commission, established in RSA 21-K:23, a state agency that contracts with the private sector for the use of film or video in an advertising, promotional, or educational program shall use New Hampshire talent whenever possible.

II. In this section[,]:

(a) “New Hampshire talent” means the people used both in front of and behind the camera associated with the film and television industry, and the creative agencies or production companies used to hire such people.

(b) “Production company” means a person or organization engaged in the business of producing a single-media or multimedia motion picture, video, television program, photographic project, or interactive project intended for theatrical, commercial, advertising, or educational purposes.

(c) “Creative agency” means a person or organization engaged in the business of creating, planning, and handling advertising as well as providing overall marketing and branding strategies and promotions for its clients. The agency is typically independent from the client and provides an outside point of view to the effort of selling the client’s products or services.

2 Effective Date. This act shall take effect 60 days after its passage.
