STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to fees for fuel oil discharge prevention and cleanup.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Increase in Import Fees. Amend RSA 146-E:3, II to read as follows:

II. A fee of [$.01] $0.0125 per gallon of fuel oil shall be assessed at the time of importation into this state. Persons licensed under RSA 146-A:11-b, II shall be liable for payment of this additional fee which shall be collected and enforced in the manner described in RSA 146-D:3, III and V. All fee revenues shall be deposited in the fuel oil discharge cleanup fund. If the fund's balance becomes greater than $2,500,000, the assessment of fees shall be discontinued and only reestablished when the fund's balance is less than $1,500,000. Until the fund balance reaches $2,000,000, at least 50 percent of the fees collected shall be allocated for reimbursements to on-premise-use facility owners and owners of land upon which on-premise-use facilities are located and for the administrative, technical and legal support associated with such reimbursements.

2 Effective Date. This act shall take effect July 1, 2009.

HB 296-FN-A - FISCAL NOTE

AN ACT relative to fees for fuel oil discharge prevention and cleanup.

FISCAL IMPACT

    The Department of Environmental Services states this bill will increase state restricted revenues and expenditures by $683,075 in FY 2010 and each year thereafter. This bill may increase state, county and local expenditures by an indeterminable amount in FY 2010 and each year thereafter. This bill will have no fiscal impact on county and local revenues.

METHODOLOGY

    The Department of Environmental Services states this bill increases existing fuel oil fees paid by licensed distributors from $.01 per gallon to $.0125 per gallon. The Department states this fee provides restricted revenues designated to the Fuel Oil Discharge Cleanup Fund. The Department expects fuel imports in FY 2010 and thereafter to at least equal FY 2008 imports (273,229,900 gallons). Under this assumption the Department estimates state restricted revenues will increase by $683,075 (273,229,900 Gallons * $.0025/Gallon) in FY 2010 and each year thereafter. The Department states expenditures for reimbursements will increase by an equal amount.

    The Department states licensed distributors may pass all or a portion of the import fee increase through to state, county and local governments but the exact fiscal impact cannot be determined at this time.
